Virtual Tour Hosting Subscription

Welcome to The View Pro, Inc. Virtual Tour Hosting Subscription ("the Service"). These Terms of Service ("the Agreement") govern your use of our Service, the virtual tours ("the Assets") you create or host with us, and other related services provided by The View Pro, Inc. ("we", "us", "our"). Please read this Agreement carefully.
This Agreement is between The View Pro, Inc. and the entity or person agreeing to these terms ("Customer", "You", "Your") and governs your access to and use of the Service.
Acceptance of Terms
This Agreement becomes effective when you commence using the Service or when you are presented with these terms and continue to use the Service ("Effective Date"). We may update these terms periodically, and continued use of the Service constitutes acceptance of the updated terms. If you do not agree, please discontinue use of the Service.
1. Service Provision and Modification
We continuously improve the Service. However, we reserve the right to modify features, billing practices, or operational aspects of the Service at any time. The Service is provided "AS IS" without warranties of any kind, and our liability is limited to the subscription fee paid by you in the preceding twelve months. You may not use the Service for any illegal purposes, to infringe on intellectual property rights, or to engage in activities that violate our Guidelines.
2. Age Requirements
You affirm that you are at least 13 years old or the minimum age of digital consent in your country, and have the legal authority to enter into this Agreement.
3. Use of Information
You agree to provide accurate information for billing and contact purposes. Our privacy policy, available on our website, outlines how we handle your data.
4. Rights and Responsibilities
You retain ownership of Assets created with our Service, subject to the terms of this Agreement and applicable law. By using the Service, you grant us a non-exclusive license to use the Assets as part of providing the Service. This includes the right to public display, distribution, and the creation of derivative works.
5. DMCA and Intellectual Property
We respect intellectual property rights and have a DMCA policy in place. If you believe your rights are being infringed, please contact us according to our policy.
6. Dispute Resolution
Any disputes under this Agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you opt-out of arbitration within 30 days of the date you first agree to these terms.
7. Billing and Cancellation
Subscriptions may be cancelled at any time. Refunds are not provided for any remaining portion of the subscription term.
8. Limitation of Liability and Indemnification
We are not liable for indirect damages or lost profits. You agree to indemnify us for any third-party claims resulting from your use of the Service.
9. General Provisions
This Agreement is governed by the laws of Texas, USA, without regard to its conflict of laws principles. If any part of this Agreement is found to be unenforceable, the remaining parts will remain in effect. This Agreement constitutes the entire agreement between you and The View Pro, Inc. regarding the Service.
